Conditions of participation for competitions on Facebook and Instagram



General Conditions of Participation for Competitions of the Pfeffingen Winery - hereinafter "Organizer"


1. Scope/Exemption from Facebook

These conditions of participation apply to all sweepstakes conducted by the organizer via its Facebook page (link) or Instagram profile (link). The competitions are not connected to Facebook or Instagram, they are in no way sponsored, endorsed or organized by Facebook or Instagram and do not establish any legal claims. All information relating to the competitions is provided exclusively by the organizer. 


2. Eligible Entrants/Participation

By participating in the competition, the Facebook / Instagram user expressly accepts these general conditions of participation. The minimum age for participation is 18 years. Employees of the organizer are excluded from participation. Participation is only possible via personal Facebook or Instagram registration. If the organizer becomes aware of technical manipulations or any other violation of these conditions of participation, he will exclude the participant from the competition. Technical manipulation includes multiple registrations by a person, participation via a sweepstakes service or similar automated collective participation services. In these cases, the prize can also be subsequently revoked and a replacement winner drawn.

The start of the competition is the respective publication time on the Facebook page or the Instagram profile of the organizer. Participation is only possible up to the specified draw date.

Depending on the competition, participation is possible, for example, by liking a post or commenting on it.

Please refer to the description of the competition on the relevant profile of the organizer to find out which specific actions are required in each case in order to take part in a competition organized by the organiser.

Participation after the specified date for drawing the prize has expired is excluded. The electronically logged receipt by the organizer is decisive. The organizer cannot be held responsible for any technical faults, such as any breakdowns in the telephone network or faults on the server, which prevent timely participation.


3. Profits/Determination of Profits/Liability

The price will be specified in the respective competition posting. A payout of the prize value in cash or an exchange of the prize is excluded. The profit claim is non-transferable.

Determination/acceptance of prizes: The determination of the winner is usually carried out by lottery (random principle), unless other information on the determination of the prize has been given.

The winners will be determined immediately after the end of the competition and announced under the respective competition posting.

The winner must provide the organizer with their contact and address details via "private message" within 24 hours of their name being published under the posting (including Sundays and public holidays). If the winner does not confirm acceptance of his prize within this period, his claim to the prize will be forfeited without replacement. There is no obligation to accept the prize.

The legal process is excluded.

4. Liability

In general, the organizer does not offer prizes provided by cooperation partners or prize sponsors in its own name but in the name of the prize sponsors. In such cases, the organizer is not responsible for the timely and complete distribution of the prize or for material or legal defects or for any insolvency of the cooperation partner/prize sponsor and the resulting consequences for the competition. Insofar as the non-cash prize is an offer from a third party (winemaker, gastronomy, trade, etc.), the organizer of the competition is not liable for non-performance or poor performance within the framework of the prizes drawn or any damage suffered by the winner when using the service. The respective business or travel conditions of the prize sponsors apply. The winner must address any warranty or damage claims exclusively to the service provider/prize sponsor.

Otherwise, the organizer is only liable for damage in connection with the raffle that was caused intentionally or through gross negligence by its own employees or other vicarious agents. As the competition provider, the organizer is not liable for damage due to malfunctions in technical systems, for delays or interruptions in transmissions or for damage in connection with participation in the competition.


5. Privacy

As part of the competition, personal data will be collected from the winner and any accompanying persons. We need this data for the purpose of processing the competition. For this purpose, in particular the surname and first name, postal address and e-mail address of the persons concerned are collected, stored and used. In the event of a win, the organizer is also entitled to publish the Facebook or Instagram profile picture and the name of the winner (also outside of Facebook, e.g. on the website). By participating in our Facebook or Instagram competitions, each participant also agrees to our data protection guidelines.

6. Early termination of the Sweepstakes

The Promoter reserves the right to change, cancel or terminate the Sweepstakes without prior notice to the Sweepstakes due to unforeseen circumstances. The latter applies in particular if errors in the software and/or hardware occur and/or other technical and/or legal reasons affect the regular and proper execution of the competition or make it impossible.


7. Miscellaneous

The competition is exclusively subject to the law of the Federal Republic of Germany. Should one or more of the above clauses be or become void, ineffective or unenforceable in whole or in part, the remaining conditions shall remain in effect. A corresponding valid clause takes its place. The same applies if there is a loophole.
